The Purposes and Legal Bases of Data Processing

Schwer Fittings GmbH processes its personal data in accordance with the EU General Data Protection Regulation (DSGVO), the Federal Data Protection Act (BDSG) and all other relevant legal provisions.

- For the fulfillment of contractual obligations (Article 6 (1) (b) GDPR)

The processing of data takes place in order to fulfill a contract with you or to carry out pre-contractual measures, which take place at your request.

- As part of the balance of interests (Article 6 (1) f DSGVO)

If necessary, we process your data beyond the actual fulfillment of the contract, for the protection of legitimate interests of us or third parties. Examples:

• Advertising, as long as you have not objected to the use of your data
• Asserting legal claims and defense in legal disputes
• detection and elimination of abuse; prevention and investigation of crimes
• Ensuring IT security and IT operations of Schwer Fitting GmbH

- On the basis of your consent (Art. 6 (1) a DSGVO)

Insofar as you have given us consent to the processing of personal data for specific purposes (eg use of your e-mail address for sending out the newsletter), the legality of this processing is based on your consent. Given consent can be revoked at any time. This also applies to the revocation of declarations of consent, which were issued to us before the validity of the GDPR, ie before 25.05.2018. The revocation of consent does not affect the legality of the data processed until the revocation.

The personal data that you provide to us, e.g. If you submit an application, contact request or e-mail (eg name, address or e-mail address), will only be processed in order to correspond with you and only for the purpose for which you provided us with the data.

To receive the newsletter, a valid (working) e-mail address is required. The IP address you use to sign up for the newsletter and the date on which you order the newsletter are also saved. This data could be used as proof of misuse if an alien e-mail address for the newsletter is registered. In addition, to ensure that an e-mail address is not abused by third parties in our mailing list, we work in accordance with the law with the so-called "double opt-in" procedure. As part of this process, the order of the newsletter, the dispatch of the confirmation email and the receipt of the confirmation of registration will be logged.

You have the option to revoke your consent to the storage of the data, your e-mail address and their use for the newsletter dispatch, at any time. An unsubscribe link is provided in every newsletter and on the website. You may also inform us of your request for cancellation via the contact options mentioned in this document.

Categories of recipient of personal data

Within Schwer Fittings GmbH, those entities have access to the personal data they need to perform their duties.

We only pass on your personal data to the shipping company responsible for the delivery, insofar as this is necessary for the delivery of the goods. To process payments, we pass on your payment data to the bank responsible for the payment.

We assure you that we do not pass on your personal data to third parties, unless we are legally obliged to do so or if you have given us your prior consent.

Duration of Data Retention

Basically, your personal data will be delted  as soon as it is no longer required for the aforementioned purposes, unless we are required by law to provide proof and retention (commercial laws, tax laws, tax code) for further storage. The storage periods are thereafter up to 10 years. In addition, we store personal data only in individual cases, if this is required in connection with claims against our company (statutory limitation period of up to 30 years).
